Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Astherix Software (“we”, “us”, “our”), the operator of ScrollSprout. They apply to the ScrollSprout app for iPhone and iPad (the “App”) and this website (together, the “Service”).

By downloading, accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

You must be at least 13 years old to use ScrollSprout. If you’re under the age of majority where you live (18 in the Philippines), you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for any purchases.

You need an account to use ScrollSprout’s AI features. You can sign in with Apple, Google or your email address. You agree to give accurate information, keep your sign-in secure, and tell us promptly at info@astherixsys.com if you think someone else has accessed your account. You’re responsible for activity that happens under your account.

Your journeys and learning progress are stored on your device and are not synced to your account. If you delete the App, change devices or delete your account, that on-device data may be lost, and we can’t restore it.

ScrollSprout requires a paid subscription. New subscribers may be eligible for a 1-week free trial.

• Billing. Subscriptions are purchased through the App Store and charged to your Apple Account. The price, billing period and any free trial are shown in the App before you confirm your purchase. Prices may vary by country and may include applicable taxes.
• Free trial. When the trial ends, your subscription starts automatically and you’ll be charged unless you cancel at least 24 hours before the trial ends. Free trials are limited to one per eligible person, as determined by Apple. If you buy a subscription during a free trial, any unused part of the trial ends.
• Automatic renewal. Your subscription renews automatically at the end of each billing period, at the then-current price, unless you turn off auto-renew at least 24 hours before the period ends. Your Apple Account is charged within the 24 hours before the period ends.
• Cancelling. You can manage or cancel your subscription at any time in your device’s Settings → your name → Subscriptions (Apple’s instructions). Cancelling stops future renewals; you keep access until the end of the period you’ve already paid for. Deleting the App or your account does not cancel your subscription.
• Refunds. All payments are processed by Apple, so we can’t issue refunds ourselves. You can request a refund from Apple, which decides refunds under its own policies.
• Price changes. If the price of your subscription changes, you’ll be notified in advance as required by Apple and applicable law, and, where required, asked to agree before the new price applies.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable license to download and use the App for your own non-commercial purposes on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, distribute, sell, rent or sublicense the App, or reverse-engineer it except where the law allows this despite this restriction.

“Your Content” means the topics, questions and article links you submit. You keep ownership of Your Content. You give us a limited permission to use, copy and transmit it (including to our AI providers) only as needed to provide the Service to you. As our Privacy Policy explains, we don’t store the content of your AI requests.

You’re responsible for Your Content, and you confirm that you have the right to submit it. Only share links to material you’re allowed to access and use for your personal learning.

Subject to these Terms, you may use the learning content generated for you for your own personal, non-commercial purposes. Because AI responses are generated automatically, similar content may be generated for other users.

ScrollSprout uses artificial intelligence from third-party providers to create lessons, examples, quizzes and answers. AI-generated content may be inaccurate, incomplete, outdated or misleading, even when it sounds confident.

• Content in ScrollSprout is for general learning only. It is not professional advice of any kind, including medical, legal, financial, psychological or safety advice.
• Check important information with reliable, authoritative sources before relying on it.

When using ScrollSprout, you agree not to:

• break any law, or infringe anyone’s intellectual property, privacy or other rights;
• use the Service to create content that is illegal, sexually exploits minors, promotes violence, harassment or self-harm, or helps cause real-world harm;
• try to get around usage limits, subscription checks or safety measures, or access the Service in ways we don’t provide (for example with bots, scripts or scrapers);
• interfere with, overload or disrupt the Service or our servers, or try to access other users’ accounts;
• use the Service to build a competing product, or to train or improve AI models; or
• resell or commercially exploit the Service, or use it in a way that breaks the usage policies of our AI providers.

The Service relies on third parties, including Apple, Google, our AI providers and the websites you link to. Your use of their services may be governed by their own terms and privacy policies. We aren’t responsible for third-party websites, services or content, including articles you choose to bring into ScrollSprout.

The Service, including the App, its design, software, text, graphics and the ScrollSprout name and logo, is owned by Astherix Software or its licensors and protected by intellectual property laws. These Terms don’t give you any rights in our trademarks or branding.

If you send us feedback or suggestions, we may use them to improve ScrollSprout without any obligation to you.

We’re always improving ScrollSprout, so features may change, be added or be removed over time. We may also suspend or discontinue all or part of the Service. If we discontinue the Service entirely, we’ll give you reasonable notice where we can.

You can stop using ScrollSprout at any time and delete your account from the App’s Settings or by emailing us. Remember to cancel your subscription separately through Apple.

We may suspend or close your account if you seriously or repeatedly break these Terms, if required by law, or to protect the Service or other users. Where reasonable, we’ll tell you why. Sections that by their nature should continue after termination (such as ownership, disclaimers, limitation of liability and governing law) will continue to apply.

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that the Service will be uninterrupted, error-free or always available, or that AI-generated content will be accurate or complete.

To the extent permitted by law, Astherix Software won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of, or inability to use, the Service, including any reliance on AI-generated content.

To the extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid for ScrollSprout in the 12 months before the claim arose.

Nothing in these Terms limits or excludes liability that can’t be limited or excluded by law, or affects rights you have as a consumer that can’t be waived by contract.

To the extent permitted by law, you agree to indemnify and hold Astherix Software harmless from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms.

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. Any dispute will be resolved by the competent courts of the Philippines, except where the law of the country you live in gives you the right to bring a claim in your local courts.

If you downloaded the App from Apple’s App Store, you and we also agree that:

• These Terms are between you and Astherix Software only, not Apple. Astherix Software, not Apple, is solely responsible for the App and its content.
• Your license to use the App is limited to using it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility.
• Astherix Software, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the App or your use of it infringes their intellectual property rights, Astherix Software, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the App, such as your mobile data plan.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

• These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
• If any part of these Terms is found unenforceable, the rest stays in effect.
• If we don’t enforce a right straight away, we haven’t given it up.
• You may not transfer your rights under these Terms. We may transfer ours, for example as part of a merger or sale of our business, as long as your rights aren’t reduced.

We may update these Terms from time to time. We’ll post the new version on this page and update the “Last updated” date. If the changes are significant, we’ll let you know in the App before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms; if you don’t agree, you can stop using the Service and cancel your subscription.
